Your use of this service, or any other ApplyYourself services, is subject to the terms and conditions contained herein. By accessing or using this online application, you agree to be bound by these terms and conditions. ApplyYourself may revise these terms and conditions at any time, and any revisions shall be binding upon you and your future access to the online application. USE OF ONLINE APPLICATION
You may use your online application for the sole purpose of applying electronically to an educational institution that has engaged ApplyYourself to provide the online application service. You agree to provide true and accurate information about yourself. You will not impersonate any other person or attempt to access another user's account under any circumstance.
Access to the online application is available through a unique User Name and password that will be created for you in the 'create account' process. You are responsible for maintaining the confidentiality of your account User Name and password. If you forget your User Name or password, please use the "Technical Support" link located on the online application login screen to submit a request to our technical support staff to obtain your information. Please include the following information in your request: Full name, email address (under which you registered your account), date of birth, institution(s) to which you are applying and what information you need (User Name and/or password). If you believe your User Name and/or password have been compromised or your account has experienced unauthorized access, it is your responsibility to notify ApplyYourself as soon as possible at https://app.applyyourself.com/AYContactHelpDesk/TechSupport.asp.
You agree to abide by any security standards of ApplyYourself. Under these standards, you shall not attempt to gain unauthorized access to any part of the ApplyYourself system (data, materials, information, computer systems, networks, databases or servers) through hacking, password mining or by any other means. You agree never to obtain, or attempt to obtain, through the ApplyYourself system, any information regarding the status of your online application or admission to the institution through any means other than a screen display within the online application or through accessibility by a visible link. Any such attempt shall subject you to immediate sanction by ApplyYourself and potentially the institution to which you are applying and termination from access to the site, among other sanctions.
You agree not to use any device, software or routine that may interfere in any way with the functioning of the online application system, or take any action that is deemed by ApplyYourself, in its sole and absolute discretion, to impose any unreasonable burden or load on the ApplyYourself systems.
This site provides links and pointers to websites and documents of other institutions. Because ApplyYourself does not operate and has no control over these sites and documents, ApplyYourself is not responsible for your ability to access these sites via the Internet. Further, ApplyYourself does not endorse products, courses, services, or information provided by other institutions on these sites.
Accordingly, ApplyYourself is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with, use or reliance on any user or other content, goods, courses or services available on or through any other site.
YOUR DATA
Any data you provide and save in your application will be immediately available to the institution to view and access. The institution will not review your application in its entirety until you submit it. Once you submit the application, you relinquish all rights in the application and it becomes the sole and absolute property of the institution. The institution may modify your application according to the institution's needs and internal policies. ApplyYourself does not review your application or play any role in the institution's admissions process.
Your in-progress application account will be kept active for 1 year following your last date of access. After this period of time, your User Name and password will remain valid, but your application data will be removed.
LAWS AND REGULATIONS
Access and use of the online application is subject to all applicable federal, state and local laws and regulations. Unauthorized use of this service is prohibited and violators can be prosecuted under federal and state laws. Virginia law and Federal law will govern the interpretation and enforcement of these terms and conditions. If any provision or term of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision or term shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of the remaining provisions or terms.
COPYRIGHT AND TRADEMARK INFORMATION
All information contained in the online application is protected by copyright law. ApplyYourself or the institutions owns copyrights in the selection, coordination, arrangement and enhancement of such information, as well as in the content original to it. Any modification, transmittal, publication, participation in the transfer or sale, creation of derivative works, or any exploitation of any of such content, in whole or in part, is strictly prohibited. Any duplication or adaptation of the HTML code used to generate web pages on the site is also forbidden. Logos used are trademark property of either ApplyYourself or the respective institution. Downloading copyrighted material is permitted for personal use only, on the condition that all copyright and other proprietary notices are kept intact. Except as otherwise expressly permitted under copyright law or these Terms of Use, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material shall be permitted without express permission of ApplyYourself. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.
LIMITATION OF LIABILITIES AND WARRANTIES
Information in the Online Application is provided "as is" without any warranty of any kind, either express or implied. To the fullest extent possible under applicable, local law, ApplyYourself disclaims all warranties, express or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. ApplyYourself does not warrant that the functions contained in the website or the online application will be uninterrupted or error-free, that any defects will be corrected, or that this website, or the servers on which this site is hosted, are free of viruses or other harmful components, nor does it make any warranty as to the timeliness or accuracy of the results that may be obtained by using the online application service, or as to the accuracy, reliability or content of any information or service provided through the ApplyYourself online application and service.
All responsibility and risk for your use of the site, use of the Internet in general, and use of the information posted by you or accessed by you and for your conduct on and off the site is assumed by you. These risks may include, but are not limited to, the risk of physical harm, of dealing and communicating with strangers, with persons inside or outside the jurisdiction of the United States, with minors or with persons acting under false pretenses.
You agree to hold ApplyYourself (and its officers, directors, employees, or agents) harmless from and against any indirect damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data, lost employment or educational opportunity, or business interruption) that result from or arise out of a connection with any documents posted by you, or the use or access to, or the inability to use or access, the site and/or any document, whether based on warranty, contract, tort, or any other legal theory, and whether or not ApplyYourself is cognizant of the possibility of such damages.
Some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, and as such the limitations set forth in the preceding paragraph may not apply. If any provision of these Terms of Use is held inapplicable or unenforceable for any reason, in the event indirect damages are awarded, ApplyYourself shall be held liable for no more than U.S. $100.00. ApplyYourself (and its officers, directors, employees, or agents) shall also be held harmless for any direct damages in excess in the aggregate of U.S. $100.00 in such cases.
Due to the nature of these Terms of Use, in addition to monetary damages, ApplyYourself shall be entitled to equitable relief upon a breach of these Terms of Use by you. ApplyYourself shall use reasonable efforts to provide you with timely notice of any claim, suit, or proceeding and may assist you, at your expense and upon your election, in defending any such suit, claim or proceeding.
